SEC. 5-089. PERSONS SENTENCED FOR VIOLATION OF CITY ORDINANCES TO LABOR ON STREETS:
All prisoners confined in the County Jail of the County of San Joaquin, State of California (which is also used as the City Jail of the City of Stockton), who are sentenced to serve a term in said jail by the Police Court of the City of Stockton for the infraction or violation of any City Ordinance, shall do common labor on the streets of the City of Stockton, or on other property or improvements owned by said City, at the option of the said City, provided that such a prisoner need not work if he claims that his physical condition does not permit such work and his claim is substantiated by the City Surgeon.

SEC. 5-090. PRISONERS' HOURS OF LABOR:
Each prisoner serving a prison term as aforesaid shall, if his health permits, labor five (5) days per week, from the hours of 9:00 a.m. to 11:30 a.m., and from the hours of 1:30 p.m. to 4:30 p.m.
SEC. 5-091. SELECTION OF PRISONERS TO LABOR ON STREETS, ETC.:
The Chief of Police is authorized to select, each day, from among the persons mentioned in Section 5-089 hereof, such number of them as he shall deem expedient for the labor to be performed upon such day, and cause them to be transported, for such purpose, to any place within or without the said City.
SEC. 5-092. PRISONERS' "TIME OFF" FOR LABOR PERFORMED:
For each day of labor so performed by said prisoner for said City of Stockton during which his conduct is reported by the officer in charge to be commendable, one-half (1/2) day shall be deducted from the term of his sentence.
SEC. 5-093. POLICE DEPARTMENT TO HAVE CONTROL AND CUSTODY OF PRISONERS LABORING ON STREETS, ETC.:
All prisoners who are removed from the County Jail for the purpose of working for the City of Stockton under the terms hereof, shall be in the care and custody of the Police Department of the City of Stockton, or in the care of a police officer especially appointed by said Police Department from one of the several departments of said City of Stockton, for the purpose of directing and watching said prisoners.
SEC. 5-094. PRISONERS' COMPENSATION FOR LABOR PERFORMED ON STREETS, ETC.:
Prisoners performing labor as hereinabove provided shall be paid one dollar ($1.00) per day. Their labor, however, is compulsory and they shall not be considered to have the status of employees. (Amended by Ordinance No. 2087 Approved Aug. 2, 1948)
