SALE BY POLICE DEPARTMENT OF STOLEN, ABANDONED OR UNCLAIMED PROPERTY


SEC. 5-131.4. AUTHORITY TO SELL:

The Police Department of the City of Stockton is hereby authorized to sell or donate to nonprofit organizations stolen, abandoned and other unclaimed private property which has been held in police custody for more than four (4) months without identification thereof, or claim thereto, made by its owner or owners.

SEC. 5-131.4.1. AUTHORITY TO SELL BICYCLES:

The Police Department of the City of Stockton is hereby authorized to sell stolen, abandoned or unclaimed bicycles which have been held in police custody for more than three (3) months without identification thereof, or claim thereto, made by its owner or owners.

The Police Department may, in lieu of selling such bicycles, donate them to qualified nonprofit organizations in accordance with City policy.

SEC. 5-131.5. NOTICE, PUBLICATION AND SALE BY AUCTION:

Any such property sold rather than donated must be sold at public auction to the highest bidder for cash after notice of the time and place of such sale has been given by the Chief of Police at least five (5) days before the time fixed therefor by publication once in a newspaper of general circulation published in the City.

SEC. 5-131.6. DEPOSIT OF FUNDS:

Any money received from the sale shall be turned over to the Finance Department and placed in the general fund of the City of Stockton.
